1. Acceptance of Terms

By creating an account, accessing, or using the Swurl platform (swurl.io), including any associated mobile applications, features, and services (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not create an account or use the Platform.

Swurl reserves the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email or in-app notification.

2. About Swurl

Swurl is a professional networking and growth platform designed for creative and technology professionals. The Platform facilitates structured expertise sharing, actionable feedback from vetted experts, peer critique, mentorship, and meaningful career connections in an ad-free environment. Swurl is not a job board and is not a replacement for licensed professional advice.

3. Eligibility and Account Registration

You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that all information you provide is accurate, current, and complete, and that you will keep it updated.

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You agree to notify Swurl immediately at support@swurl.io if you suspect unauthorized access to your account.

Swurl reserves the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.

4. Expert Vetting and Platform Roles

Swurl operates a vetting process for individuals designated as experts, mentors, or critique providers on the Platform. Vetting may include review of professional credentials, portfolio work, references, and public professional profiles. While Swurl takes reasonable steps to verify expert qualifications, Swurl does not guarantee the accuracy, completeness, or suitability of any expert’s advice, feedback, or credentials. Users should exercise their own professional judgment when acting on any guidance received through the Platform.

Expert status may be revoked at Swurl’s sole discretion if an expert fails to maintain community standards, delivers low-quality feedback, or violates these Terms.

5. Critique Board, Feedback, and Insights

5.1 Critique Board. The Critique Board allows users to post finished or in-progress creative work and receive structured feedback from vetted senior professionals. By posting work to the Critique Board, you grant Swurl and participating reviewers a limited, non-exclusive license to view, discuss, and reference your work solely for the purpose of providing critique within the Platform. This license does not transfer ownership of your work.

5.2 Insights Feature. Swurl may offer a paid Insights feature that allows users to submit professional questions or challenges privately. Content submitted through the Insights feature is shared only with the assigned coach or expert and is treated as confidential within the Platform. Swurl does not guarantee specific outcomes or results from any Insights engagement.

5.3 AI-Assisted Suggestions. Swurl may use third-party artificial intelligence tools (such as the Claude API by Anthropic) to provide supplemental suggestions or guidance within the Platform. AI-generated content is informational only and does not constitute professional advice. Where AI tools are used, Swurl will indicate the AI provider. You acknowledge that AI-generated suggestions may be incomplete or inaccurate and should not be relied upon as a sole basis for professional decisions.

6. Privacy, Confidentiality, and NDA Compliance

6.1 Your Privacy. Swurl is committed to protecting user privacy. Our collection, use, and storage of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Swurl is ad-free and does not sell user data to third-party advertisers.

6.2 Confidentiality Between Users. While Swurl fosters a respectful professional community, Swurl does not enforce or monitor non-disclosure agreements (NDAs) between users or between users and their employers. If you share work that is subject to an NDA, confidentiality agreement, or other contractual restriction, you do so at your own risk. It is your sole responsibility to ensure that any work or information you upload to the Platform does not violate any obligation you have to a current or former employer, client, or other third party.

6.3 Employer Visibility. Swurl is designed with privacy in mind. Your profile and activity are not shared with or visible to your employer unless you choose to make them public. However, Swurl cannot guarantee absolute anonymity on the internet. If you are seeking career guidance related to a job search, please exercise appropriate discretion.

7. User Content and Intellectual Property

7.1 Ownership. You retain ownership of all content you create and upload to the Platform, including portfolio pieces, profile information, critique posts, and written feedback (“User Content”).

7.2 License to Swurl. By uploading User Content, you grant Swurl a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your User Content solely as necessary to operate and improve the Platform. This license ends when you delete your content or your account, except where your content has been shared with other users in the normal course of Platform use (for example, critique feedback you have provided).

7.3 No Tolerance for Theft. Swurl takes intellectual property seriously. Users may not copy, reproduce, download, or redistribute another user’s work without explicit written permission from the content owner. Violations will result in immediate account suspension or termination.

8. Community Standards and Conduct

Swurl is built around respect, empathy, and constructive professional growth. By using the Platform, you agree to the following:

Provide actionable, constructive feedback. Feedback should be specific, respectful, and aimed at helping the recipient grow. Toxic positivity, personal attacks, and unconstructive criticism are not welcome.

Respect others’ time and expertise. When requesting help, provide sufficient context so that experts can assist you effectively. Follow through on guidance you have requested.

Do not misrepresent your qualifications. Accurately represent your skills, experience, and professional background.

No harassment, discrimination, or hate speech. Swurl has zero tolerance for harassment, bullying, discrimination based on any protected characteristic, or any behavior that makes the community unsafe.

No spam, solicitation, or self-promotion. The Platform is not a marketplace for unsolicited sales or advertising.

9. Payments, Fees, and Refunds

Certain features of the Platform, including expert consultations and the Insights feature, may require payment. All fees will be clearly disclosed before you are charged. Payments are processed through third-party payment processors (such as Stripe) and are subject to their respective terms of service.

Expert compensation, where applicable, is handled through Swurl’s payment system. Swurl may retain a percentage of expert engagement fees as a service fee, which will be disclosed to experts at the time of onboarding.

Refund requests will be evaluated on a case-by-case basis. If you are dissatisfied with a paid service, please contact support@swurl.io within 14 days of the transaction.

10. Accessibility

Swurl is committed to making the Platform accessible to users of all abilities. We strive to comply with WCAG 2.1 Level AA standards and welcome feedback on accessibility at accessibility@swurl.io. Accessibility features may include, but are not limited to, speech-to-text output and descriptive alt text for all images.

11. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Swurl does not warrant that the Platform will be uninterrupted, error-free, or secure. Swurl is not responsible for the accuracy or quality of any advice, feedback, or content provided by experts, users, or AI tools on the Platform.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWURL’S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO SWURL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

12. Account Termination

You may delete your account at any time by contacting support@swurl.io. Swurl reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that Swurl determines, in its sole discretion, violates these Terms or is harmful to other users, the Platform, or third parties.

Upon termination, your right to use the Platform ceases immediately. Sections related to intellectual property, limitation of liability, and governing law survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in Denver, Colorado, in accordance with the rules of the American Arbitration Association.
